Chains for Tracks® are designed as a traction-enhancing accessory for rubber-tracked skid steers and similar tracked machinery, specifically for use in snow and icy conditions or other low-traction environments. While this product is engineered for durability and performance, improper installation, misuse, or operation outside of recommended conditions may result in equipment damage or personal injury. It is the responsibility of the operator to ensure proper fitment, regular inspection, and safe usage in accordance with all applicable safety guidelines and machine manufacturer recommendations. By purchasing, installing, or using this product, the user acknowledges and accepts all risks associated with its installation and operation. Chains for Tracks®, Inc. and its affiliates assume no liability for accidents, damages, or injuries resulting from improper use or failure to follow instructions. Always use caution when operating machinery in hazardous conditions.
The user assumes full responsibility for ensuring compatibility with their specific machinery, proper installation, regular maintenance, and adherence to all operating instructions and safety guidelines. Misuse, improper installation, failure to check clearance for your machine, or use in conditions for which the product was not designed may result in equipment damage, personal injury, or death.
Under no circumstances shall Chains for Tracks®, Inc., its owners, employees, distributors, or affiliates be liable for any direct, indirect, incidental, consequential, or special damages arising out of or in connection with the use or inability to use this product, even if advised of the possibility of such damages. Use of this product constitutes acceptance of these terms.
Product Liability Disclaimer – Terms and Conditions
By purchasing, installing, or using Chains for Tracks®, you (“the user”) acknowledge and agree to the following terms and conditions. Chains for Tracks® are aftermarket traction devices designed for use with rubber-tracked skid steers and similar tracked machinery in snow, ice, or other low-traction conditions. These products are not approved or certified by any original equipment manufacturer (OEM) and are to be used at the sole risk of the user.
Chains for Tracks®, Inc. shall not be held liable for any damages, losses, or injuries arising from the chains provided by the Company becoming loose, detaching, or coming off during use. The Customer acknowledges that the proper installation, maintenance, and inspection of the chains are solely their responsibility, and any failure to secure, maintain, or properly fit the chains may result in malfunctions that can cause damage to machinery, attachments, tracks, or other property. The Customer agrees to assume all risks associated with the use of the chains and agrees to indemnify and hold Chains for Tracks®, Inc. harmless from any claims resulting from such incidents.
Assumption of Risk
The user acknowledges that operating heavy machinery in hazardous weather or terrain carries inherent risks. The user assumes full responsibility for the installation, inspection, maintenance, and operation of Chains for Tracks®. It is the user’s duty to ensure proper fitment, compliance with equipment specifications, and safe operating practices at all times. Chains for Tracks® are traction-enhancing devices, but still have limitations with how much additional traction is provided.
Chains for Tracks® are mechanical traction devices and are not indestructible. The user acknowledges that improper installation, inadequate inspection, excessive speed, operation on unsuitable surfaces, or failure to exercise reasonable caution may result in accelerated wear, damage, loosening, or detachment of the product during use.
Operational Vibration Notice
By installing and using Chains for Tracks® traction devices, the user acknowledges that the addition of chains to rubber tracks may increase machine vibration during operation. The amount and severity of vibration can vary significantly based on several factors, including but not limited to:
The operating surface, with hard surfaces such as concrete or asphalt producing increased vibration compared to off-road surfaces such as dirt, gravel, or snow;
The rubber track tread pattern and design, including whether the chains are able to sit within tread grooves or rest higher on the track surface;
The make, model, condition, and suspension characteristics of the machine, including machines that already exhibit a rough or rigid ride.
The user understands and accepts that the installation of Chains for Tracks® may amplify existing ride roughness or vibration characteristics of the equipment. Chains for Tracks®, Inc. shall not be held liable for discomfort, increased vibration, wear, or operational characteristics resulting from the use of the product.
Limitation of Liability
Under no circumstances shall Chains for Tracks®, Inc., its owners, employees, affiliates, suppliers, or distributors be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to property damage, equipment failure, loss of profits, personal injury, or death, arising out of or related to the use or inability to use this product, regardless of the legal theory under which such damages are sought, even if Chains for Tracks®, Inc. has been advised of the possibility of such damages.
Indemnification
The user agrees to indemnify, defend, and hold harmless Chains for Tracks®, Inc., its affiliates, officers, agents, employees, and successors from any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to the use, misuse, or installation of this product.
Compliance with Laws
It is the responsibility of the user to ensure that the use of Chains for Tracks® complies with all local, state, and federal laws, as well as any regulations or restrictions imposed by equipment manufacturers or insurers.
Modification of Terms
Chains for Tracks®, Inc. reserves the right to update or modify these Terms and Conditions at any time without prior notice. Continued use of the product following any such changes constitutes acceptance of the revised terms.
Shipping and Delivery Disclaimer
Chains for Tracks®, Inc. is not responsible for delays in shipping, delivery, or transit once an order has been transferred to the carrier. Shipping times provided at the time of purchase are estimates only and are not guaranteed. Delays may occur due to factors beyond the control of Chains for Tracks®, Inc., including but not limited to carrier delays, weather conditions, supply chain disruptions, labor shortages, customs processing, or other unforeseen circumstances.
Chains for Tracks®, Inc. shall not be held liable for any losses, damages, or expenses resulting from shipping delays, including but not limited to downtime, loss of use, loss of income, or project delays. The Buyer acknowledges and accepts that all delivery timelines are subject to carrier performance and external conditions.
Limitation of Liability for Damage to Hard Surfaces
By purchasing and using products from Chains for Tracks®, Inc., the Buyer acknowledges and agrees that Chains for Tracks®, Inc. shall not be held liable for any damage, wear, or deterioration caused to hard surfaces, including but not limited to concrete, asphalt, or other paved surfaces, during the use of the products. The Buyer assumes full responsibility for any such damage that may occur as a result of using the products on hard or abrasive surfaces.
The Buyer further acknowledges that operating equipment with Chains for Tracks® on hard surfaces significantly reduces the service life of the chains. Unlike traditional tire chains that roll with wheeled equipment, rubber-tracked machines slide across hard surfaces during operation, which increases friction and accelerates wear on the chains. Operation on concrete, asphalt, or other hard surfaces will result in substantially greater wear compared to operation solely in off-road conditions such as dirt, gravel, or snow.
The Buyer further agrees to indemnify, defend, and hold harmless Chains for Tracks®, Inc., its officers, employees, agents, and affiliates from any and all claims, demands, actions, liabilities, costs, or damages arising from or related to damage to hard surfaces during the use of the products.
This limitation of liability applies whether such damage is direct, incidental, consequential, or otherwise, and regardless of whether the damage occurs in normal or improper use of the products.
Restriction on Resale and Manufacturing Rights
By purchasing and/or using products related to track chains from Chains for Tracks®, Inc. (hereinafter referred to as “Seller”), the purchaser (hereinafter referred to as “Buyer”) acknowledges and agrees that the products are intended solely for the Buyer’s internal, commercial operations and not for resale, redistribution, or manufacturing. The Buyer shall not, without the prior written consent of Chains for Tracks®, Inc.:
Resell, lease, license, sublicense, distribute, or otherwise transfer the products or any portion thereof to any third party;
Manufacture, reproduce, or create derivative works based on the products or any part thereof, either alone or in combination with other materials or products;
Engage in any activities that involve the replication or modification of the products for commercial gain or distribution.
Any breach of this provision will constitute a material violation of the terms of purchase and may result in legal action, including but not limited to claims for damages, injunctive relief, and the immediate termination of any warranties associated with the products.
